2. ACCEPTANCE OF TERMS
By creating an account or using the Platform, the User declares:
- Has read, understood and fully accepts these Terms and Conditions
- Is at least 18 years old
- Has full legal capacity
- Is not a resident of USA, UK, Canada, Australia, China (PRC), or India
3. SERVICE DESCRIPTION
SignalRadar is an online FINANCIAL INFORMATION platform offering:
- Fundamental analysis on stocks and crypto, auto-generated from public data
- Pulse Sentiment graphics (composite Fear & Greed Index)
- Options flow data (Put/Call ratios, volume, OI)
- Insider and Congress trades (public SEC EDGAR data)
- Economic calendars and financial news
- Technical analysis (Williams %R, CCI, MFI, Aroon, PSAR, VWAP, Ichimoku, Bollinger Bands)
- Backtest strategies on historical data
IMPORTANT — NOT INVESTMENT ADVICE:
Platform content is strictly informational and educational. It does NOT constitute:
- Personalized investment advice
- Buy/sell recommendations
- Regulated financial consultancy
- Market prediction
Provider is NOT authorized as an investment services provider by Romanian financial authority (ASF).
4. ACCOUNT CREATION AND USE
Account creation requires valid email + password (min 8 characters) + acceptance of these Terms and the GDPR Policy.
User is responsible for password confidentiality.
A User may have only one account. Multiple accounts may be suspended without notice.
5. PLANS AND PRICING
SignalRadar offers the following plans (all with 14-day free trial on paid plans):
FREE — 0 EUR/month: 25 tickers, weekly digest, Q/R scores
STARTER — 4.99 EUR/month (49.90 EUR/year, -17%): 50 tickers, RadarScope 5/day, SmartMoney
PRO — 9.99 EUR/month (99.90 EUR/year, -17%): 200 tickers, unlimited RadarScope, FlowSignal, Multi-TF TA
TRADER — 19.99 EUR/month (199.90 EUR/year, -17%): 500 tickers, AI Strategy Signals, 15 advanced indicators, Ichimoku, custom alerts
ELITE — 39.99 EUR/month (399.90 EUR/year, -17%): 1500 tickers, REST + WebSocket API, MacroPulse, PortfolioX, Priority Support
All prices are in EUR.
For EU B2B customers with valid VAT ID, invoices are issued with Reverse Charge mention (Art. 196 EU Directive 2006/112/EC).
Payment is via Stripe (PCI DSS compliant processor).
User's card is NOT charged during the 14-day trial period.
After trial expiration, subscription auto-renews monthly/annually.
6. RIGHT OF WITHDRAWAL (EU CONSUMERS)
In accordance with Romanian OUG 34/2014 and EU Directive 2011/83/EU, consumer Users (natural persons) have the right to withdraw from the contract within 14 days of conclusion, without needing to justify.

During the 14-day trial, User pays NOTHING.
After 14-day period expires, subscription can be cancelled anytime. Payment for the already-paid period is not refunded, but access is maintained until the end of the period.
7. USER OBLIGATIONS
The User undertakes:
- Not to use the Platform for illegal activities
- Not to copy, distribute, commercialize content without written permission
- Not to perform DDoS attacks, automated scraping, reverse engineering
- Not to access other Users' accounts
- Not to use data for unfair competition
Violations may lead to account suspension or termination, refusal of refunds, and legal action for damages.
8. INTELLECTUAL PROPERTY
All Platform content (source code, design, graphics, texts, own databases) is the property of SERVSOFT MAG WEB S.R.L. and is protected by Romanian Law 8/1996 and EU Directives.
Public data (prices, volumes etc.) comes from third-party sources (SEC EDGAR, FRED, Stripe, exchanges) and remains their property.
"SignalRadar" trademark registration is in progress with OSIM (Romania) and EUIPO (EU).
9. LIMITATION OF LIABILITY
Provider is NOT liable for:
- Financial losses resulting from User's investment decisions
- Accuracy or timeliness of data provided by third parties (SEC EDGAR, FRED etc.)
- Temporary service interruptions for maintenance
- Cyberattacks exceeding reasonable protection measures
- Legislative changes affecting Platform use
Provider's total liability to a User is limited to the amount paid by that User in the last 12 months.
Technical and fundamental analysis data is provided "AS IS" and "AS AVAILABLE". User accepts that:
- Historical analyses do not guarantee future performance
- AI models may have biases or errors
- Financial markets are inherently volatile and unpredictable
10. PERSONAL DATA PROTECTION (GDPR)
Provider processes personal data in accordance with EU Regulation 2016/679 (GDPR) and Romanian Law 190/2018.

User has the right:
- To access their data (Art. 15 GDPR)
- To rectification (Art. 16 GDPR)
- To erasure - "right to be forgotten" (Art. 17 GDPR)
- To restriction of processing (Art. 18 GDPR)
- To portability (Art. 20 GDPR)
- To object (Art. 21 GDPR)
- To file complaint with Romanian Data Protection Authority (www.dataprotection.ro)

11. TERMS MODIFICATION
Provider reserves the right to modify these Terms at any time.
Significant changes will be notified to Users by email at least 30 days before entry into force.
Continued use of the Platform after the entry-into-force date constitutes acceptance of the new Terms.
If User does not accept the new Terms, they have the right to cancel their subscription without penalty.
12. FORCE MAJEURE
Neither party shall be liable for non-performance of obligations as a result of force majeure events (Art. 1351 Romanian Civil Code): war, natural disasters, government decisions, pandemics, major global cyberattacks etc.
13. DISPUTE RESOLUTION
Any disputes arising from Platform use shall be resolved amicably through direct negotiations.
If amicable resolution is not reached, parties will resort to:

If none of the above methods work, the competent courts are those in Cluj-Napoca, Romania.
14. APPLICABLE LAW
These Terms are governed by Romanian law, in particular:
- Civil Code (Law 287/2009)
- OUG 34/2014 (consumer rights)
- Law 365/2002 (electronic commerce)
- Law 363/2007 (combating unfair commercial practices)
- Regulation (EU) 2016/679 (GDPR)
- Directive 2011/83/EU (consumer rights)
